Everyday, thousands of Americans suffer from the lasting side effects of legally prescribed drugs. Life for them becomes a struggle as they deal with pain, embarrassment, and costly medical bills.

Many of these people have legitimate claims to sue the drug’s manufacturer but choose not to. And, why would they anyway? When a pharmaceutical company is sued the lawyers make millions of dollars while the real victims are lucky to even get a penny. Right? No, absolutely not. That is not the case.

In typical “class action” lawsuits, it’s often true that the victims end up receiving a relatively small sum of money while the lawyers make out like bandits. In these types of lawsuits, all victims are treated as one individual plaintiff or “class.”  When the defendant company loses, they pay out a seemingly large amount of money, but the money is then divided by the hundreds, if not thousands of people included in the class.  What’s much better than a class action lawsuit is a mass-tort.

Mass-Tort Cases:

Each victim is treated as an individual and files their own separate suit against the manufacturers. These settlements or judgments often provide very large sums of money to the individual.

This legal method of settlement is fair because of its individualistic nature. A claimant who suffered from serious conditions such as blood clots, stroke, or heart attack, for example, will be highly compensated.

Awards in such cases are commonly in excess of $250,000.

Sounds good, right, but who pays for the legal fees if you don’t win?

That’s the best part. In a mass-tort lawsuit, if you don’t receive any money, you don’t owe your lawyer a penny.  In other words, you have nothing to lose.

The key difference between class actions and mass torts involves the treatment of each individual plaintiff. In mass torts, each plaintiff is required to show individual harm or injury caused by the defendant. In a class action lawsuit, one person is selected from amongst the group to serve as a class representative, and it is that representative who stands in for the rest of the plaintiffs. –The Palm Beach Post
